This document represents the general terms and conditions of use of a virtual platform for the sale of goods for all orders placed by the customer (hereinafter referred to as “You” , “Customer”) to TEX SPLtd. and the site www.tony. bg (“tony.bg”) and its subdomains (hereinafter referred to as “TONY BG”, “us” or “we”), the mobile version or the mobile application or by telephone. If you continue to use the site and place orders on it, we consider that you accept these terms.
These General Terms and Conditions comply with the requirements of the Consumer Protection Act (CPA) with the following website https://kzp.bg/, as well as with other regulations in force in the Republic of Bulgaria. The electronic platform for online resolution of consumer disputes (ODR platform) will start operating on 09.01.2016 – its address is https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home. show & lng = EN platform offers consumers and traders within the EU the opportunity to try and achieve out-of-court settlement of complaints arising from online purchases. The new Alternative Dispute Resolution (ADR) and Online Dispute Resolution (ODR) rules aim to increase the use of ADR schemes in the EU, giving consumers a fast, cheap and informal way to resolve disputes with traders as an alternative to often lengthy court proceedings.
General applications
By using the site www.tony.bg you agree to be bound by the conditions specified here ( “Terms”). Make sure you read and understand the Terms before placing your order.
Orders can be placed only by persons over 18 years of age who have indicated a residence address or other address in Bulgaria (except for the office of the courier company, which is our partner).
We reserve the right to change these Terms, as the version of the Terms that will apply to your order will be the one that is published on www.tony.bg at the time you place the order.
Order
You can place your order at www.tony.bg or by phone +359 888/757 -770. Once you place an order, you will receive a confirmation email if you have provided one.
When ordering you must specify
-valid email address
-correctly filled in address for delivery of the goods
-correctly filled in contact details – two names, phone
If you have set a valid email, you will be able to track the movement of your order when your order status changes.
The customer undertakes and is responsible for all purchase data to be correct, complete and accurate as of the date of sending the order.
Adding a product and / or service to the shopping cart does not lead to registration of the stick and automatic saving of the product / service
If for any reason we are unable to fulfill your order, we will notify you as soon as possible. If you have paid for your order in advance, we will refund the corresponding amount using the same payment method that was used to make the payment.
By registering the order, you allow us to contact you at the specified phone number to confirm the order. We reserve the right not to send your order without confirming it by phone.
We reserve the right to refuse to fulfill (cancel) your order if you have provided incorrect data, also in case of technical errors in the publication of the site and we do not owe you compensation, except to refund the amounts paid by you so far, if any, using the same payment method that was used to make the payment.
Methods of Payment
With “cash on delivery” – payment in cash to the courier upon delivery. As with the use of payment by “cash on delivery” you pay to the courier (our Partner), with whom we have an agreement for payment of cash on delivery by postal money order by bank transfer. The legal basis for the service is Ordinance № Н – 18 of 2006, Art. 3 for “Registration and reporting of sales made”. According to the text in the ordinance, one of the options, which releases us from the obligation to issue and send you the receipt with the shipment, is the payment to Us to be made by Postal Money Order. This service is performed only by a licensed postal operator.
You will receive a “Receipt for acceptance of money transfer” for the payment made by you by the Courier

Delivery
We will send your order only after confirmation by phone. After a successfully registered order we will contact you during our working hours – from 8:00 to 17:00 from Monday to Friday. If your order is placed after 5 pm on Friday or on weekends, we will contact you on the first working day.
After confirming your order, it is released for processing. The standard delivery time is 30 days. Our goal is to deliver your orders within 7 working days after confirmation. Although we strive to make delivery within 7 working days, it may take longer due to unexpected events. In case the delivery time exceeds 30 days, you can cancel your order.
We send by Econt courier to a convenient address for you (standard delivery is from BGN 4.60, the amount varies depending on the value of the imposed payment, the weight of your shipment, as well as the location.) You can also request the cheapest delivery method , which is Bulgarian Posts http://www.bgpost.bg/bg/calculator. It is possible for your convenience to send the order via Speedy or Leo Express.
Guarantees
The Seller offers all Goods on the Site with a guarantee of conformity of the goods with the Contract in accordance with the legislation in force in the country of operation and the warranty policy of the respective manufacturer or official distributor of the Goods.
Withdrawal from the Contract / Complaints /
The customer has the right to make a complaint or return a product purchased from the e-shop within 14 (fourteen) days of receipt of the product.
Withdrawal from the contract may be made before the courier upon delivery of the goods, if the goods are delivered after the deadline for reasons beyond the Customer and are not due to force majeure.
In case of withdrawal from the contract, the Customer is obliged to return the purchased goods in undamaged commercial form and with a preserved label.
Upon withdrawal from the contract, if the Customer has paid for the goods, he is refunded the amount paid for the returned goods, using the same method of payment that was used to make the payment.
CPA: Art. 54. (Amended, SG No. 61/2014, effective 25.07.2014) (1) Where the consumer has exercised his right to withdraw from the distance contract or from the off-site contract, the trader shall reimburse all amounts received by the consumer, including delivery costs, without undue delay and not later than 14 days from the date on which he was notified of the consumer’s decision to withdraw from the contract under Art. 52.
(2) The trader shall be obliged to refund the amounts received, using the same means of payment used by the consumer in the initial transaction, unless the consumer has expressed his explicit consent to use another means of payment and provided that this does not involve costs for the consumer. .
(3) The trader shall not be obliged to reimburse the additional costs for delivery of the goods, when the consumer has explicitly chosen a way of delivery of the goods, different from the cheapest type of standard delivery offered by the trader.
(4) In case of a contract of sale, when the trader has not offered to collect the goods himself, he may withhold the payment of the amounts to the consumer under para. 1, until he receives the goods or until the consumer presents proof that he has sent the goods back, whichever occurs first.
A complaint is made when the purchased goods do not comply with the agreement between the parties to the contract of sale. The discrepancy in the agreement between the parties may be expressed in:
- production defects of the goods;
- ascertained shortages of parts of the goods;
- wrong product is sent, different from the ordered one;
- non-compliance with the announced size and / or color – goods sent in a different size and / or different color from the ordered;
- damage to the goods during transportation.

In case of a complaint, the Customer may choose to replace the specific item for the same without defects or in another size, or another color, or return the goods against a refund. An e-shop consultant may offer to replace the item with a completely different item when equalizing the prices – either the Customer pays extra if the other item is more expensive, or two items are offered for the same price, or the User is refunded the difference between the exchanges. and the new item, if the price of the new item is lower than the price paid by the User.
The return of the goods in case of complaint, in cases outside the factory defect or damage during transport, is carried out under the following conditions:
- Original commercial type (the goods are not torn, scratched, worn, washed, ironed).
- There is no damage caused by improper use.
- Preserved original packaging and label.
In case of replacement of goods on claim, the transport costs are at the expense of the trader in both directions, as the replacement was necessary due to the fault of the e-shop.
The photos are for illustrative purposes. We make every reasonable effort to adequately display our products, including their composition and colors. The color you see depends on your computer system, and we cannot guarantee that your computer will display these colors correctly.
